Ghost Writer Terms of Use

These terms are an agreement between you and Ghost Media Works ("we", "us"), the maker of Ghost Writer. By installing or using Ghost Writer you agree to them. If you don't agree, don't install or use it. Please read section 8 and section 9: they limit what we are responsible for.

You must be at least 13 years old to use Ghost Writer. If you are under 18, a parent or guardian must agree to these terms for you. During the beta, access keys are offered only to people in the United States.

1. What you may do

Ghost Writer is free and available by invitation. Once you have an access key, we give you a personal, non-exclusive, non-transferable licence to install and use Ghost Writer on the number of PCs your key allows, for your own personal or work use.

You may not:

  • share, sell or publish your access key, or let others use it;
  • get around, disable or fake the access key check, or any other limit built into the app;
  • copy, sell, rent or redistribute Ghost Writer, except as the open-source licences below allow;
  • reverse engineer, decompile or take apart Ghost Writer's own code, except where the law lets you do so despite this term;
  • remove our name, copyright notices or the open-source credits;
  • use Ghost Writer to break the law or to harm, record or spy on other people.

Ghost Writer includes open-source software and AI models made by others, listed in NOTICES.txt with their licences. Those parts are yours to use under their own licences, and nothing in these terms takes away any right those licences give you.

Advanced mode, if you download it, includes NVIDIA software. You may use it only as part of Ghost Writer, and you may not copy it out, reverse engineer it or use it on its own. NVIDIA's licence applies to it: https://docs.nvidia.com/cuda/eula/

2. A beta, by invitation

Ghost Writer is a beta. It may have mistakes, change, lose features or stop working. We may pause, limit or end any access key, pause Ghost Writer for everyone, or turn a feature off for everyone, at any time, for example to stop misuse or fix a problem. We may stop offering Ghost Writer altogether. Ghost Writer checks for and offers updates. We may require a newer version before Ghost Writer keeps working, and some fixes may only be available in the newest version. We may show short messages in Ghost Writer about the app, for example about an update or a problem.

3. Your words stay yours

What you say, write and create with Ghost Writer belongs to you. Ghost Writer does the work on your PC and does not send your voice or your words to us. If you send us ideas, suggestions or bug reports, we may use them to improve our products without owing you anything for them. Please never include anything private you dictated.

4. Check before you send

Speech recognition and AI make mistakes. They can mishear you, choose the wrong word, or reword something in a way you didn't mean. Always check text before you send, publish or rely on it. Don't rely on Ghost Writer where a mistake could cause harm, for example for medical, legal, financial or emergency use, or anything that needs exact wording.

5. Other people's voices and privacy

Ghost Writer listens through your microphone, and with some features (such as always listening, voice notes and screen context) it may hear or read things about other people. You are responsible for using it lawfully. Where the law requires it, get people's permission before recording them or writing down what they say. Don't use Ghost Writer to record or transcribe calls, meetings or other people's conversations without the consent the law requires where you and they are. Some places require everyone's consent.

6. Files on your PC

Some features change or remove files, for example Clean up, which can clear temporary files and empty the Recycle Bin. Files removed that way cannot be brought back. Ghost Writer asks before doing this, but you are responsible for what you choose to remove. Keep backups of anything that matters.

7. Other companies' products

Ghost Writer can open websites and other apps, and can work with AI tools you run yourself (such as Ollama or LM Studio). Those are not ours; their own terms apply, and we are not responsible for them. Names such as Windows, NVIDIA, AMD and Intel belong to their owners and are used only to describe what Ghost Writer works with.

8. No warranty

GHOST WRITER IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT OR ACCURACY, AND ANY WARRANTY THAT IT WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE. Some places don't allow these exclusions, so some of them may not apply to you.

9. Limit on our responsibility

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, FILES, PROFITS, BUSINESS OR GOODWILL, ARISING FROM OR RELATED TO GHOST WRITER OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR GHOST WRITER IN THE 12 MONTHS BEFORE THE CLAIM, OR FIFTY US DOLLARS (US$50). Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

10. If you misuse it

If you use Ghost Writer in breach of these terms or the law, and someone makes a claim against us because of it, you agree to cover our reasonable costs of that claim, to the extent the law allows.

11. Ending

You can stop using Ghost Writer at any time by uninstalling it. Your settings and notes stay in your Windows profile (%LOCALAPPDATA%\Ghost Writer) until you delete that folder. If you break these terms, your licence ends and we may end your access key. Sections 3 to 13 continue after that.

12. Changes to these terms

We may update these terms. We'll post the new version on our website and change the date at the top; for significant changes we'll also tell you in the app. Using Ghost Writer after a change means you accept the new terms.

13. Law, export and the rest

These terms are governed by the laws of the State of Michigan, USA, without regard to its conflict-of-law rules, and any dispute goes to the courts there, unless the consumer laws where you live give you the right to bring it locally. You may not use Ghost Writer where US law forbids it, or if you are on a US government list of restricted persons. If any part of these terms can't be enforced, the rest still applies. Not enforcing a term is not giving it up. These terms and the Privacy Policy are the whole agreement between us about Ghost Writer.
